1.1. The provisions of these Terms govern the relationship between you and Hiiclub (“we”, “us”, “our” or the“Company”), regarding your use of the Hiiclub mobile application, and related services (the “Application” or “Service”), including all information, text, graphics, software, and content available for your use (the “Content”).
1.2. These Terms establish a legally binding contractual relationship between you and the Company. For this reason, PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE.
1.3. You must accept these Terms to create a Hiiclub account and to access or use the Service. If you do not have an account, you accept these Terms by using any part of the Service. If you do not accept these Terms, do not create an account or use the Service.
1.4. To the extent permitted by applicable law, we may change, modify, or update these Terms at any time. Where required by law, we will notify you of material changes. Continued use of the Service after changes means you accept the revised Terms.
2.1. You must be at least eighteen (18) years of age (or the age of majority in your jurisdiction, if higher).
2.2. By accessing or using the Service, you represent and warrant that:
(a) you have the full legal capacity to enter into a binding contract under the laws of your jurisdiction;
(b) you are not barred or otherwise legally prohibited from receiving or using the Service under any applicable law, regulation, or court order;
(c) you have not been previously permanently suspended or removed from the Service; and
(d) your registration and use of the Service will at all times comply with these Terms and all applicable laws, rules, and regulations.
3.1. You may create an account to access additional features of the Application. Registration may require providing personal information as prompted.
3.2. Each User may hold only one account. Accounts are for natural persons only.
3.3. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
3.4. We may verify information and suspend or terminate accounts for non-cooperation, false information, or breaches of these Terms.
3.5. If you create an account, you represent and warrant to the Company that: (i) all required registration information you submit is truthful and accurate; (ii) you will maintain the accuracy of such information; and (iii) your use of the Service does not violate any applicable law or regulation or these Terms.
4.1. The Application is for your lawful, personal, non-commercial use only. You agree to comply with these Terms and all applicable laws. Any commercial use, including advertising, solicitation, or unauthorized data collection, is strictly prohibited unless we expressly authorize it in writing.
4.2. You must not engage in any prohibited activities, including but not limited to: (a) uploading or sharing illegal, harmful, abusive, or objectionable content; (b) impersonating any person or entity or misrepresenting your affiliation; (c) harassing, bullying, intimidating, or threatening other Users; (d) scraping, hacking, introducing malware, viruses, or other harmful code; (e) engaging in any criminal activity; and (f) any form of child sexual exploitation or abuse (strict zero tolerance), which we will report to law enforcement.
4.3. We reserve the right to suspend or permanently terminate your access at any time, without prior notice, if we reasonably believe you have violated this Section or the Terms. Upon termination, your right to use the Application ceases immediately.
5.1. All rights, title, and interest in and to the Application and its Content (including software, code, graphics, text, images, logos, trademarks, and other materials) are the exclusive property of the Company or its licensors, protected by copyright, trademark, and other intellectual property laws.
5.2. Subject to your strict compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Application solely for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the Application or its Content unless expressly authorized by us in writing.
5.3. Nothing in these Terms grants you any ownership rights in the Application or its Content. All rights not expressly granted herein are reserved by the Company. Except as stated in Section 5.2, your use of the Application does not confer any license or right under any patent, trademark, copyright, or other proprietary right of the Company or any third party.
6.1. You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to your User Content, and that such content does not infringe, misappropriate, or violate the intellectual property, privacy, publicity, or other rights of any third party.
6.2. Prohibited User Content includes, but is not limited to, any material that is unlawful, defamatory, obscene, threatening, harassing, hateful, invasive of another's privacy, or infringing; any content involving the exploitation or sexualization of minors (which we will report to law enforcement); and any spam, unauthorized advertising, or other commercial solicitation.
6.3. By submitting, posting, or displaying User Content on or through the Application, you grant: (a) other Users a limited, non-exclusive, revocable license to access and view that User Content solely through the Application for personal, non-commercial purposes; and (b) the Company a worldwide, perpetual, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, publish, publicly display, distribute, and promote your User Content in any media formats and through any channels, in connection with operating, providing, promoting, and improving the Application and our related services.
6.4. We may, but are not obligated to, monitor, review, edit, or remove User Content at any time, without notice and in our sole discretion. We assume no liability for any User Content, including for any loss or damage arising from its removal or failure to remove it.
6.5. You are solely responsible for your User Content and for any consequences of posting it. We do not endorse any User Content, and your reliance on any User Content is at your own risk.
To keep Hiiclub safe, Users must follow these rules.
7.1. Prohibited Activities. You must not impersonate others, create fake accounts, use unauthorized photos, share personal information in profiles, include external links or ads, engage in harassment, bullying, or discrimination, engage in or promote criminal activities.
7.2. Sexualized Content & CSAM. Explicit sexual content is prohibited, including depictions of genitalia, sexual acts, sex toys, or sexual fluids. There is zero tolerance for child sexual exploitation, grooming, or sexualization, including fictional or animated depictions. Violations will be reported to law enforcement.
7.3. Harassment & Bullying. You must not threaten, blackmail, intimidate, disclose private information without consent, or post discriminatory or hateful comments.
7.4. Criminal Activities & Violence. You must not post content promoting or depicting violence, abuse, animal cruelty, self-harm, terrorism, drug use, or weapons.
7.5. Enforcement. Violations may result in removal of content, suspension or termination of accounts, and reporting to authorities.
8.1. The Application may be used free of charge, but we may also offer optional in-app purchases of additional features, content, or digital items.
8.2. All in-app purchases are processed exclusively through the Apple App Store or Google Play and are subject to their respective terms and conditions. We do not process payments directly.
8.3. Except where required by applicable law, all purchases are final and non-refundable. You waive any right to withdraw from or cancel a Purchase once completed.
9.1. You are solely responsible for your interactions with other User. We do not screen or verify Users and make no representations about their conduct or intentions.
9.2. To the fullest extent permitted by law, we disclaim all liability for disputes, losses, or injuries arising from your interactions with other Users, whether online or offline.
9.3. You must exercise caution when sharing personal information. Please report any abusive or unlawful conduct using our in-app tools, though we are under no obligation to intervene.
10.1. The Application is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
10.2. We do not warrant that the Application will be uninterrupted, timely, secure, or error-free; that any defects or errors will be corrected; or that the Application and its servers are free of viruses or other harmful components.
10.3. No advice or information obtained by you from us or through the Application will create any warranty not expressly stated in these Terms. We are not responsible for the accuracy, completeness, or reliability of any content posted by Users or third parties.
11.1. To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages.
11.2. Our aggregate liability to you shall not exceed the amount you paid (if any) for the Application.
11.3. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or other liability that cannot be excluded under applicable law.
12.1. You agree to indemnify and hold harmless Hiiclub, its affiliates, officers, directors, and employees from claims, damages, or expenses arising out of your User Content, use of the Application, or breach of these Terms.
